A judge here sentenced a Wisconsin man to probation and jail time this morning for having sexual contact with a 13-year-old girl.
Dustin O'Connor, of Beloit, Wis., had previously pleaded guilty to a Class AA felony gross sexual imposition charge accusing him of raping the girl in July 2008 in Fargo.
East Central Judicial District Judge Georgia Dawson sentenced O'Connor, 27, to five years, first to serve 221 days, with the balance suspended for a period of five years of supervised probation.
O'Connor was given credit for 221 days previously spent in custody, meaning no additional jail time is required.
The sentence was a joint recommendation from both the defense and prosecution. Assistant Cass County State's Attorney Leah Viste said the agreement reflects O'Connor's cooperation and willingness to take responsibility.

"He was willing to plead guilty immediately," Viste said.
There were also issues with evidence and conflicting statements in the case Viste said, adding it would have come down to "he said, she said" at trial.
