A former BSU football player accused of sexually assaulting a woman in February was found not guilty by a jury on Thursday in Beltrami County District Court. Trial proceedings began Dec. 1.
Joshua Riley Malone, 20, of Gordon, Wis., faced a felony third-degree criminal sexual conduct charge for allegedly having sex with an unconscious victim at a house party on Feb. 21. Malone pleaded not guilty to the charge in July.
According to court documents, the victim reportedly became highly intoxicated at the party and woke up in Malone's bed. Malone indicated the woman was not unconscious when he had sex with her.
Malone was suspended from the BSU football team pending the outcome of the investigation. BSU has not yet released an official statement on Malone's status on the team following the verdict.
