DL man gets jail time, CD treatment, for domestic assault

A felony charge of fifth-degree controlled substance crime, possession, was dropped in a plea agreement.

According to court records, on Aug. 13, he assaulted his live-in girlfriend, pushing her down a flight of stairs and hitting her with a broken piece of handrail from the stairs.

When he was booked into the Becker County Jail, officers found 27 Xanax pills in his possession pills that had been prescribed to his girlfriend.

Xanax is a benzodiazepine used to treat anxiety and panic disorder.

On Thursday, District Judge Peter Irvine sentenced him to serve 180 days in jail, all but 63 days stayed two years.

He was fined a total of $550 plus court fees. Contact will be allowed only under supervision at Pine Manor residential treatment center, which Sherbert was ordered to attend.

He must complete a domestic violence group and get a neuropsychological evaluation, as well as submit to random drug and alcohol testing.
