The following information contains felony charges from complaints filed recently in Hubbard County District Court.
Failure to appear
Jamie Lee Bevins, Jr., 24, of White Earth, is charged with felony failure to appear. Bevins was arraigned Jan. 21 on the felony charge of possession of stolen property, punishable by a maximum of five years in prison and/or $10,000 fine.
He was appointed a public defender and given conditions of release including, but not limited to, making all future court appearances. On March 21, Bevins was given verbal and/or written notice that his next court appearance was May 16.
Bevins failed to appear and the court issued a warrant on May 16, according to court documents.

Theft
Heather Lenona Oppegard, 32, of Detroit Lakes, is charged with felony theft.
On March 28, a Park Rapids police officer responded to Wal-Mart for a report of a woman stealing merchandise.
The asset protection manager told the officer a woman identified as Oppegard had allegedly taken significant items without paying.
According to the criminal complaint, Oppegard allegedly used a shopping cart and filled it with women’s clothing, children’s clothing, automotive accessories, cleaning supplies and food.
She is accused of taking the filled shopping cart out of the store without paying for the items then putting the items in her car.
The value of the stolen items was $1,261.34.
The officer reviewed surveillance video and identified the woman as Oppegard.

The felony charge is punishable by a maximum five years and/or $10,000 fine.
Domestic Assault
Joshua David Brill, 32, of Nevis, is charged with one count of felony domestic assault.
On June 25, a Hubbard County Sheriff’s deputy responded to a residence in Nevis where he observed numerous household items thrown about the yard, including a refrigerator.
The deputy spoke to Brill, who stated he slept in his van when he arrived home and awoke to his girlfriend moving her property out of the house. According to the criminal complaint, Brill stated he told his girlfriend to calm down and not remove property in front of their kids.
Brill stated his girlfriend hit him on the head with a frying pan. He then stated he held his girlfriend on the ground.
The deputy spoke to the girlfriend who stated the defendant arrived home in the morning after being out drinking all night. She became upset with the defendant and told him she was done and he became upset.
The girlfriend, according to the complaint, stated Brill pushed her and started throwing her things in the front yard. She claims when she tried to stop him he pushed her to the ground and began to choke her.

The girlfriend stated it was at this point she hit him with the frying pan.
The felony charge is punishable by three years in jail and/or $5,000 fine.
Controlled substance
Steven Lee McCluskey, 53, of Alexandria, was arrested and charged with fifth degree controlled substance on June 18 near Park Rapids.
According to the complaint, a Hubbard County deputy was stopped at the intersection of Crocus Hill Street and County Road 6 when he observed a car signal to turn left and suddenly turned right onto the road leading to the transfer station.
The deputy made contact with the driver who explained he was lost and trying to get to Wadena.
The driver identified himself and appeared nervous, but the deputy could not verify the name. The driver stated he gets nervous around cops. The driver admitted to the deputy he lied about his name and was identified as Steven Lee McCluskey.
His driver’s license was revoked.

The deputy observed in plain view a hypodermic needle stuck to the back of the driver’s seat. McCluskey admitted there was a meth pipe in the center console of the vehicle and methamphetamine in a cigarette package, the complaint stated.
The deputy allegedly found a piece of paper with several small crystals, which field tested positive as methamphetamine.
The fifth degree controlled substance charge is punishable by maximum five years prison and/or $10,000 fine.
Drug possession
Jeanie Kay Titcomb, 54, of Park Rapids, was charged with fifth degree drug possession following a probation check on June 24.
During the probation check Titcomb allegedly admitted to using methamphetamine and search of her residence revealed a micro baggie containing meth.
Penalty for the felony charge is a minimum of six months in jail and maximum $20,000 fine.

Ryan Anthony Burnos, 34, of Nevis, was charged with fifth degree drug possession after probation officers located several drug paraphernalia items and a micro baggie containing methamphetamine.
Penalty for the felony charge is a minimum of six months in jail and maximum $20,000 fine.
Driving While Impaired
Kenneth Dean Heidelberger, 29, of Lake George was charged with one count of driving while impaired, refusing to submit to chemical test; and one charge of first degree DWI, under the influence of alcohol.
On June 26 at 2:54 a.m., a Park Rapids police officer observed a vehicle traveling southbound on Highway 71 and radar indicated the vehicle was traveling 40 mph in a 30 mph zone.
The officer identified the driver as Kenneth Dean Heidelberger. The officer observed bloodshot and watery eyes, according to the complaint, along with strong odor of alcohol and slurred speech.
The complaint states the defendant agreed to field sobriety testing, which showed impairment in all three tests. The defendant refused a breath test and was arrested for driving while impaired.
Heidelberger also refused a breath test at the jail.

A check of Heidelberger’s criminal history reveals convictions for driving while impaired in 2011, 2012 and 2015. His driving privileges were cancelled in 2015.
Both felony counts are punishable by seven years in jail and/or $14,000 fine.
Assault on a peace officer
Frank George Moore III, 62, of Park Rapids, is charged with one count of fourth degree assault on a peace officer.
On May 28 at 10:40 a.m., a Hubbard County deputy received a report of a possible intoxicated driver southbound on County Road 4. A short time later a Park Rapids police officer was dispatched to L&M Fleet regarding a possible medical problem.
It was at that time the medical call concerned the person in the intoxicated driving complaint, according to court records.
The person was identified as Frank George Moore III. Officers observed slurred speech, strong odor of alcohol and bloodshot, watery eyes.
Moore was allegedly verbally abusive to the officers and medical personnel. He was taken to the hospital and continued to be verbally abusive and raised his clenched hand at the deputy.
The officer and deputy handcuffed Moore, and Moore then spit at the officer’s face, according to the complaint.
Moore was taken to the Hubbard County Jail and results of a breath test indicated a BAC of .25.
A check of Moore’s driving privileges show he has an alcohol and/or drug restriction on his license.
Penalty for the felony assault charge is three years in jail and/or $6,000 fine.
