MINUTES BOARD OF COMMISSIONERS HUBBARD COUNTY, MINNESOTA TUESDAY, MAY 17, 2022 9:00 AM HUBBARD COUNTY BOARD ROOM PRESENT: DAVID DE LA HUNT, TED VAN KEMPEN, CHARLENE CHRISTENSON, DAN STACEY, AND TOM KRUEGER ABSENT: PLEDGE OF ALLEGIANCE BOARD CHAIR CALL TO ORDER a) Meeting called to order at 9:00am 1 AGENDA APPROVAL a) Add County Assessor update on County Board of Appeal and Equalization to the agenda and move Item 11A, Reappointment of the Highway Engineer, into Section 5 Highway/Survey. Commissioner Christenson made a motion to approve the Agenda as amended. Commissioner De La Hunt seconded the motion. Carried 2 PUBLIC INPUT No one spoke during Public Input 3 CONSENT AGENDA a) Approve Minutes b) Auditors Warrants and Claims c) Social Services Warrants and Claims d) Approve Cash Balance Reports for month ending April 30, 2022. e) Approve 2023 Budget Schedule f) Accept AIS Partner Donations Resolution 05172022001 g) Adopt Resolution 05172022002, Accepting Sheriff’s Office Donations h) To accept Resolution 05132022003 for donations to support the Recreation Account for Replacement Windscreens at the Pickleball Courts at Heartland Park i) To Approve a New Application and Resolution 05172022004 for Waste Haulers License for Rapid Roll Off of Park Rapids, MN. j) Approve Application to Conduct Excluded Bingo for Lake George Area Senior Citizens. k) Consent Agenda Approval There are no changes to the Consent Agenda. Commissioner Stacey made a motion to approve Consent Agenda as presented. Commissioner Krueger seconded the motion. Carried 4 COUNTY EMPLOYEE RECOGNITION a) County Employee Recognition Auditor/Treasurer Kelley Jansen, Deputy Auditor/Treasurer is recognized for 1+ years of service from March 29, 2021 to June 2, 2022. Facilities; Steven Guethling, Maintenance Technician II is recognized for 15 years of service, effective May 14, 2022. Natural Resources Department: Thomas Bell, Parks Maintenance Worker began the Seasonal position on May 9, 2022. 5 HIGHWAY / SURVEY a) Review and approve resolution 05172022005 authorizing purchase of right-of-way easements for Project CP 029-119-022 The Hubbard County Highway Department proposes to reconstruct and improve a portion of County Road 119, known as C.P. 029-119-022, located between 174th Ave and CSAH 33. The improvement consists of grading, full depth reclamation, aggregate base, bituminous pavement, and aggregate shouldering, said roadway as herein determined necessary to provide for the safety of the traveling public. In addition to the existing Highway Easement, certain lands are required to provide for said construction. Pursuant to Minnesota Statutes, the Hubbard County Highway Department has prepared a right of way plan. The plan is on file at the Engineer’s Office at 101 Crocus Hill Street, Park Rapids, Minnesota 56470 Commissioner Christenson made a motion to approve resolution 05172022005 for the purchase of right-of-way easements for Project CP 029-119-022 Commissioner Stacey seconded the motion. Carried b) Review and approve resolution authorizing entry into Master Partnership Contract with the MN Dept. of Transportation Renewal of 5-year contract with the MN Dept of Transportation for cooperation of services. This contract gives the highway department the ability to work directly with MN DOT and to make changes to projects on an as needed basis. Commissioner Van Kempen made a motion to approve resolution 05172022006 authorizing County Engineer and County Administrator to execute MnDOT Master Partnership Contract #1050269. Commissioner De La Hunt seconded the motion. Carried c) Project Update: Assistant Engineer Adolphson provided the Commissioners with an update on the projected start dates for various county projects. 6 ASSESSOR a) Local Board of Appeal and Equalization Meeting The Assessor’s office provided the Commissioners with an update on the current number of taxpayer appeals needing to be heard at the previously set June 13th meeting date. It was identified that additional meeting dates and times will be required. A communication will be sent to those individuals with the additional dates to coordinate their attendance. 7 NATURAL RESOURCE MANAGEMENT a) Review and approve Right-of-Way Easement for Itasca-Mantrap Electrical Association in Section 30, Township 141 North, Range 35 West (Arago Twp.). Itasca-Mantrap(IM) is requesting a right-of-way easement for an existing above-ground electrical line. IM intends to relocate the above-ground line to an underground line within the existing corridor.Commissioner Christenson made a motion to approve the right-of-way easement request of Itasca-Mantrap Electrical Association to relocate the currently above-ground electrical line locate in Section 30, Township 141 North, Range 35 West in Arago Township as drafted and authorize the County Board Chair’s signature. Commissioner Stacey seconded the motion. Carried b) Review and approve Itascatur Outdoor Activity Club’s application for MN-DNR GIA grant for Soaring Eagle Cross Country Ski Trails Itascatur Outdoor Activity Club has submitted a grant application for maintenance and grooming assistance of the Soaring Eagle Cross Country Ski Trails for FY 2023. There is no cost to the County for this grant. Resolution 05172022007 states that Hubbard County agrees to act as the local sponsor for an application for funding and upon approval of the application by the state will enter into an agreement with the state for the grant and that the Land Commissioner shall act as the fiscal agent for the grant. Carried c) Project Update: Land Commissioner Lohmeier gave an update of current and upcoming projects. 8 SOLID WASTE a) Review and approve quotes for landfill cell excavation - North Transfer Station Based on our annual waste survey completed in fall of 2021, we have filled our current working cells in the landfill (Cell 11 and Cell 12). We need to excavate Cell 13, which is our last permitted cell in order to place demolition waste. Quotes were solicited and we received one quote. Gladen’s estimate that it will take 3-4 days to complete with a cubic yard price between $1.54 to $2.06/cubic yard. Estimated total price is between $23,940.00-$31,920.00 based on 15,500 cubic yards of material being removed. After review by engineers the total excavated volume should be closer to 7,800 cubic yards, so total price should be lower, and will be based on per hour equipment rate. We are discussing with our consultants the next steps for our landfill and future areas we can fill within our current landfill permit. Cell 13 should last 2-3 years based on current fill volumes. $12,000 - $20,000 estimated price based on a per hour rate. Commissioner Stacey made a motion to approve the quote from Gladen Construction Inc. of Laporte, MN in the amount of $408.00/hour of a PC490 Excavator and $241.00/hour for a D7H Dozer for cell 13 excavation at North Transfer Station. Commissioner Van Kempen seconded the motion. Carried 9 SOCIAL SERVICES a) 2022 Social Services Managed Care Provider Procurement - Primewest Resolution Minnesota Department of Human Services 5-year procurement schedule has required the submittal of proposals for Health Care Organizations. The Social Service’s leaders in Minnesota reviewed the proposals and recommend that the Hubbard County Commissioners adopt the resolution identifying PrimeWest Health as Hubbard County’s Managed Care Organization for Minnesota Senior Health Options (MSHO), Minnesota Senior Care Plus (MSC+). There was a total of 5 applicants for this group, Blue Plus, Medica, PrimeWest, UCare, and Inited Health Care, all respondents met the minimum requirements, however as a member of PrimeWest’s County based Purchasing counties, PrimeWest was the highest scoring for Hubbard County. Commissioner Van Kempen made a motion County Board Approval and signature Commissioner Krueger seconded the motion. Carried 10 ENVIRONMENTAL SERVICES a) Preliminary Plat Application of Northwoods Aero Village Gov’t Lots 1, 2, 3, and part of Gov’t Lot 4, Section 18, Township 145, Range 32, Farden Township. Parcels 07.18.00100, 07.18.00200, 07.18.00300, and 07.18.00400. Applicant is requesting to plat 81± acres into 14 lots. Planning Commission recommendation: Andres made a motion to recommend approval to the Hubbard County Board of Commissioners of the preliminary plat application on the condition that the applicant must obtain proof from the Hubbard County Soil and Water Conservation District that whatever road is to be built will comply with the WCA prior to the final plat application being able to be submitted. Petersen seconded the motion that carried unanimously 5 – 0. Commissioner Christenson made a motion to approve the preliminary plat application of Northwoods Aero Village by Greenhead Flight Services, LLC with the condition that documentation from the Hubbard County Soil and Water Conservation District must be submitted in the final plat application that the access road to be built to service the plat will comply with the Wetland Conservation Act. Commissioner De La Hunt seconded the motion. Carried 11 RECORDER a) Adopt Certificate of Possessory Title process per MS 508A - Resolution 05172022009 The Certificate of Possessory Title process provides taxpayers with an administrative alternative to registration of land under Chapter 508: Completely eliminating the Judicial process plus saving taxpayers time and money. Commissioner Krueger made a motion to adopt the Certificate of Possessory Title process per MS 508A and approve Resolution 05172022009. Commissioner De La Hunt seconded the motion. Carried 12 HUMAN RESOURCES a) Highway Engineer/Public Works Coordinator Reappointment M. S. 163.07 provides for the county board to appoint a county highway engineer. Highway Engineer/Public Works Coordinator Jed Nordin’s current term appointment was through April 30, 2022. Statute states reappointment shall be for a term of four years, and shall be made in May of the year in which the term expires. Commissioner De La Hunt made a motion to approve the reappointment of Highway Engineer/Public Works Coordinator Jed Nordin to a term of four years beginning May 1, 2022 through April 30, 2026, in accordance with M.S. 163.07, as amended. Commissioner Krueger seconded the motion. Carried b) Informational - Job Fair Human Resources Director Teems updated the Commissioners on the Job Fair and the direct benefits the county has experienced as a result of the attendance. c) New Hire Starting Compensation - Dispatcher/Jailer (primarily Jailer) Personnel Policy, Section 5 Compensation Administration provides for starting compensation above the minimum of the compensation grade range when an applicant has long term prior experience, subject to approval by the Board. The selected applicant is returning to the position and brings four years plus experience as Dispatcher/Jailer (primarily Jailer). Effective March 12, 2022. Commissioner De La Hunt made a motion to approve the hire of a Dispatcher/Jailer (primarily Jailer) at grade 8, step 3 of the compensation grade range, upon recommendation of the County Sheriff and Personnel Policy, Section 5 Compensation Administration, effective March 12, 2022. Commissioner Christenson seconded the motion. Carried 13 ADMINISTRATOR a) Historical Society Lease and Sublease Updated 5-year lease between Hubbard County and Hubbard County Historical Society for The Old Courthouse Building located between Block 24 and Block 23 of Hollingers Subdivision of the City of Park Rapids, and the sublease to the Nemeth Art Center (North Country Museum of Arts). These leases would commence on or around June 1, 2022 and continuing until May 31, 2027. These leases have been reviewed and approved by County Attorney. Commissioner Krueger made a motion to approve and sign the 5-year lease to the Hubbard County Historical Society with 5-year sublease to Nemeth Art Center. Commissioner Stacey seconded the motion. Carried b) Administrator’s Report Administrator Cadwell provided updates on Heritage Living Center. He will be presenting information regarding the property valuation process at the next Rotary Club meeting. c) June Work Session Cancellation Following discussion surrounding the additional time required to complete the Local Board of Appeals and Equalization meetings, and with the ability to move any potential Work Session topics to different dates, it was decided the June Work Session will be cancelled. Commissioner Van Kempen made a motion to amend the Work Session Schedule by canceling the June Work Session, bringing any needed items to either the June 7th or June 21st meeting. Commissioner Krueger seconded the motion. Carried d) Closed Session of Administrator One Year Evaluation Commissioner Van Kempen made a motion to Close the Open Session and Open the Closed Session for the purpose of conducting the Administrator’s one-year evaluation. Commissioner Christenson seconded the motion. Carried Commissioner Stacey made a motion to Close the Closed Session and reopen the Open Meeting. Commissioner Van Kempen seconded the motion.
