AGENDA Hubbard County Planning Commission / Board of Adjustment Monday, August 22, 2022 The Hubbard County Planning Commission/Board of Adjustment will hold its regular public hearing and meeting on Monday, August 22, 2022 at 6:00 p.m. in the Hubbard County Government Center – County Board Room # 324. Planning Commission/Board of Adjustment (PC/BOA) hearing/meeting agenda items (i.e. applications and related documents), composition and duties, meeting procedure, and findings of fact may be viewed on the Hubbard County website (www.co.hubbard.mn.us) by clicking on the homepage “Agendas, Summaries & Minutes” link and then on the “Meetings” link on the subsequent webpage that opens. Public comment on agenda items may be made orally during the hearing/meeting or in writing. Written comments/materials on agenda items must be submitted to Hubbard County Environmental Services, 301 Court Ave., Park Rapids, MN 56470 by 3:30 p.m. on Wednesday, August 17, 2022 and include the submitter’s complete name and address of residence. Applicant is requesting a variance from: Part 1: Section 702 of the Shoreland Management Ordinance (SMO) for a proposed addition to a nonconforming dwelling located in the shore impact zone (approved on May 23, 2022) and Amended Part 2: Section 502.2 of the SMO for a proposed platform and accessory structure to be located within the 100’ ordinary high water mark (OHW) structure setback and Part 3: Section 703 of the SMO for a proposed lakeside platform that will exceed the maximum 15% of structure OHW setback waterward dimension and be located within the required 30’ minimum OHW setback. 8. NEW BUSINESS 8.1. Variance Application 14-V-22 by John Holler: Part of the E 1/2 of the SE 1/4, Section 30, Township 140, Range 34, Henrietta Township. Parcel 13.30.01540. Applicant is requesting a variance from Part 1: Section 4, Subdivision A.1.b.1 of the Subdivision Ordinance to create a tract that does not comply with the 300 ft. minimum lot width requirement and Part 2: Section 4, Subdivision A.1.b.3 of the Subdivision Ordinance to create a tract that does not comply with the 33 ft. minimum easement width requirement. 8.2. Variance Application 17-V-22 by Mike and Melinda Spry: Lots 13, 14, and 15, Bannister’s Fifth Crow Wing Addition, Section 30, Township 140, Range 33, Nevis Township on 5th Crow Wing Lake, a recreational development lake. Parcel 21.48.01000. Applicants are requesting a variance from Section 704 of the Shoreland Management Ordinance to subdivide a substandard sized unimproved nonconforming lot from adjacent nonconforming lots in the same ownership and place it in different ownership. 8.3. Variance Application 18-V-22 by Byron David: Part of the NE 1/4, Section 11, Township 139, Range 35, Straight River Township on Straight River, a forested river. Parcel 25.11.00500. Applicant is requesting a variance from Section 702 of the Shoreland Management Ordinance for a proposed addition to a nonconforming residence located in a bluff impact zone. 8.4. Variance Application 19-V-22 by James and Jona Seifert and Marty and Charlotte Peterson: Lots 4-9, Block 2, Subdivision of Outlot 2, Long Lake Park, Section 20, Township 140, Range 34, Henrietta Township near Long Lake, a recreational development lake. Parcels 13.42.40600 and 13.42.40700. Applicants are requesting a variance from Sections 501.2 and 704 of the Shoreland Management Ordinance to subdivide six existing contiguous substandard platted lots in the same ownership into two lots that do not comply with the 80,000 sq. ft. minimum non-riparian lot size requirement. 8.5. Variance Application 20-V-22 by Crooked Pines, LLC: Part of Gov’t Lot 9, Section 17, Township 141, Range 33, Mantrap Township on West Crooked Lake, a natural environment lake. Parcel 20.17.00110. Applicant is requesting after-the-fact variances from Sections 502.1 and 701 of the Shoreland Management Ordinance (SMO) for various structures, decks, and platforms added to a nonconforming use, some of which do not comply with the 150’ ordinary high water mark (OHW) structure setback. Applicant is also requesting variances from Sections 502.1 and 701 of the SMO for proposed accessory structures to be placed at all 20 campground sites, and proposed platforms to be placed at some of the campsites with some of the platforms not complying with the 150’ OHW structure setback. 8.6. Variance Application 21-V-22 by Mark and Beth Olsen: Lot 3, Block B, First Addition to Pine Haven Beach, Section 17, Township 139, Range 34, Hubbard Township on Long Lake, a recreational development lake. Applicants are requesting a variance from Part 1: Section 702 of the Shoreland Management Ordinance (SMO) for a proposed addition to a nonconforming residence located in a shore impact zone and Part 2: Section 702 of the SMO for a proposed lakeward addition to a nonconforming accessory structure that would increase its ordinary high water mark setback nonconformity. 9.
