PUBLIC NOTICE ORDINANCE NO. 193, 3rd Series KENNEL ORDINANCE AMENDMENT This ordinance amends the provisions of Section 6.44 of Wadena City Ordinances relating to kennels. Be it enacted by the Wadena City Council, as follows: Section 6.44 Kennels. Subd. 1. Defined. For the purpose of this Section, the term "Kennel" means any place, building, tract of land, adobe or vehicle, wherein or whereon three or more dogs, over six months of age, are kept, congregated, confined, boarded, or bred, or offered for sale. Subd. 2. License Required. It is unlawful for any person to operate or maintain a kennel without a license therefore from the City. All licenses shall be for the calendar year in which they are issued and shall be renewable on the first business day of the following year. Subd. 3. License Fee. The annual fee for a kennel license shall be established from time to time by resolution of they city council. Subd. 4. Conditions. The following conditions are included and apply to any kennel permit. (1) The premises and its pens, runways and all sanitary conditions; (2) Adequate light and ventilation must be provided to the animals; (3) Fecal materials must be disposed of in an approved sanitary manner; (4) The premises must be kept vermin free; (5) No public or private nuisance may be created; (6) No offensive odors may arise; and (7) The premises must be open for inspection by city authorities upon reasonable notice. Subd. 5. Statute and Regulatory Compliance. All kennels must conform to the statutes and regulations of any state or county agency having jurisdiction over such matters. Subd. 6. Noise Control. a. Building. All kennels shall be housed in buildings constructed in such a manner that animal noise can not be heard from adjoining properties. b. Outside Runways. Outside runways must be completely enclosed by a visually screening fence at least five feet in height. The kennel operator shall not permit noise to be emitted from outside runways which can be heard by adjoining property owners between the hours of 4:00 p.m. and 9:00 a.m. Subd. 7. Zoning No license shall be issued to a person for operation of a kennel in the R-1 and R-2 Zoning Districts of the City.
