Detroit Lakes man sentenced to 30 days in jail for selling cocaine

Herbert Franklyn Johnson, 54, 2172 Brook Ridge Drive, Detroit Lakes, has been sentenced in Becker County District Court for fourth-degree controlled substance crime, sale.

District Judge Joe Evans on Tuesday stayed adjudication of sentence and placed him on supervised probation for 15 years. Johnson pleaded guilty to the charge Sept. 21.

He must serve 30 days in jail, with two days credit for time served, and is eligible for home detention in lieu of jail. He must pay court costs totaling $665.

Johnson is subject to random drug and alcohol testing during his probation and must abstain from mood altering substances, including alcohol, unless prescribed by a physician.

According to court records, Johnson sold two small zip-lock bags each containing one-fourth of a gram of a substance represented as cocaine for $100 to a confidential police informant on Aug. 5, 2008 at a location on Brook Ridge Drive.

Testing by the Minnesota Bureau of Criminal Apprehension lab determined that the substance was .2 grams of cocaine.
