Second appeal filed in after-the-fact garage variance case in Hubbard County

A Nevis couple has once again appealed the denial of an after-the-fact variance request that Hubbard County officials maintain is one of the most blatant shoreland violations they’ve ever dealt with.
The attorney for David and Karen Hagert filed suit in Hubbard County District Court over a variance in February seeking to leave a three-story garage addition where it is, on Deer and Shallow Lakes. The appeal was filed last month.
This is the second appeal of a variance, which was initially denied in 2011-12.
Hagerts lost that case, which was filed based on the method by which the case was appealed. Costs have been assessed against them to the county.
The county, in denying the variance, said the addition above the garage was illegal on several issues.
The couple admitted they built the structure above the garage without a permit, but maintain they have since rectified the housing density issue by purchasing additional land.
