According to the criminal complaint, a Minneapolis police investigator who is a member of the Minnesota Internet Crimes Against Children Task Force, identified Ussery's IP address as downloading files containing child pornography.

A special agent with the Department of Homeland Security and other officers interviewed Ussery at his residence on the 1800 block of East Second Street.

Ussery admitted that he used his laptop computer to download adult pornography sites and child pornography sites that included children between 10 and 16 years old. He said the child pornography included acts of penetration and oral sex between adults and minors, the complaint alleges.

The defendant said that he did not send any images but had downloaded 15 videos of child pornography. A forensic examination was conducted of Ussery's computer and 45 videos of suspected child pornography were found. The videos depicted the children in various sexual acts with other children and adults.
