Park Rapids City Council denies variance request

The Park Rapids City Council has denied a request to allow zero parking stalls for Kimball and Undem Law Firm at 210 Court Avenue.

The building is located in the R-B Residential Business Transitional Zoning District.


Park Rapids city planner Dan Walker said the R-B district requires one parking space for every 250 square feet of floor area.

The Planning Commission held a public hearing Dec. 21 to review the variance request and recommended denying the request subject to the following conditions:

-The applicant will be able to move into the building under a Temporary Occupancy Permit after the building passes final inspection by the building inspector.

-The applicant submits an approved site plan to the city planner.

-The applicant submits a letter stating that all site work will be completed by July 1, 2010.

Walker said the Planning Commission addressed the following findings of fact:

-The applicant has not demonstrated a hardship. Economic considerations alone do not constitute a hardship for the purpose of granting a variance.

-There are not exceptional circumstances unique to this property. This parcel is symmetrical and relatively level with adequate space to accommodate the required parking stalls.

-The variance cannot be granted without upsetting the purpose and intent of the zoning ordinance.

-The variance can be granted without altering the essential character of the surrounding area; however, the concerns addressed in the other three findings of fact provide enough justification for denial of the request.

The council approved denying the request for a variance.
