The Minnesota Supreme Court has refused to hear the appeal of a domestic abuser from Lake George who wants to overturn his conviction in the vicious 2009 assault of his wife.

John Wesley Defatte, 71, had his case earlier turned away by the Minnesota Court of Appeals in June.

He was convicted of the brutal assault of his estranged wife in December 2010. This was his last avenue of appeal.

He's currently serving a 48-month sentence for breaking into Diana Defatte's Lake George home in violation of a protection order that was in place in June 2009.

Defatte admitted to an officer shortly after his 2009 arrest that, "I went over there and just, I just lost it."

He was seeking to get the statement stricken from his record, and the case retried, claiming admissibility of the statement before he had an attorney prejudiced his trial.

Diana Defatte suffered numerous injuries including a fractured eye socket and multiple contusions and a head wound. He was claiming self-defense at trial and that his wife's injuries were suffered in a fall during their altercation.

She testified to a harrowing life-and-death fight with John Defatte, in 2009, certain she would be killed.

The Appeals Court found John Defatte's defense to be "implausible" based on the injuries he inflicted on Diana.
