Lake George man convicted in domestic assault case
On December 3, 2010, after a four day trial, a Hubbard County Jury convicted John Wesley Defatte, 70, Lake George, of Burglary in the First Degree with Bodily Injury, Assault in the Third Degree causing Substantial Bodily Harm, and Violation of an Order for Protection which occurred on June 22, 2009. The Jury deliberated for less than three hours. The Jury dismissed the Counts of Assault in the Second Degree with a Dangerous Weapon and Domestic Assault by Strangulation. The case was prosecuted by Hubbard County Attorney Donovan D. Dearstyne and Assistant County Attorney Jonathan D. Frieden with the assistance of Victim Coordinator Jill Christenson. The case was investigated by the Hubbard County Sheriff's Office. Hubbard County Attorney Dearstyne made a motion after the return of the jury verdict to take the defendant into custody pending sentencing. The Court granted Mr. Dearstyne's motion. Sentencing was set for January 10, 2011 by the Court.
Defatte was remanded immediately into custody. Judge Robert Tiffany was going to allow him three days to report to jail but Hubbard County Attorney Don Dearstyne objected.
