Judge denies Helga Township TRO against farmer

A District Court judge has denied a Temporary Restraining Order by Helga Township against a local farmer that has been removing rocks from his farmstead in northern Hubbard County.

Judge Robert Tiffany ruled this week the township didn't prove it would suffer irreparable harm if the injunction was denied.

Doug Crosby and his attorney argued he was excavating rocks incidental to farming, to clear his land for pastures.

The township maintained he was illegally excavating the rocks and selling them as a commer-cial use that he was not permitted for. Helga Township's attorney said denying the injunction stopping Crosby from the excavation would promote lawlessness and a disregard for the township's zoning authority over land use.
