East Grand Forks family files wrongful death lawsuit against Wal-Mart
The family of an East Grand Forks woman is suing Wal-Mart in federal court, alleging that the superstore's negligence caused her death in 2007.
Cynthia Gaddie, 50, was shopping with a friend at the Grand Forks Wal-Mart, 2551 32nd Ave. S., on July 24, 2007, when she caught her foot on a rolling clothing rack in the fitting room and fell, according to her family's complaint.
The complaint says Gaddie was taken to the Altru Hospital emergency room and, as a result of her injuries, died Aug. 22, 2007.
The Arkansas-based corporation said any injuries Gaddie suffered in the store were her own fault and not the "proximate" cause of her death, according to the corporation's response to the suit.
The Gaddies are seeking a judgment of at least $50,000 plus attorney's fees. Wal-Mart wants the suit dismissed.
