DL man in court for taking kids away
A Detroit Lakes man made his first appearance this week in Becker County District Court on two felony counts of deprivation of parental rights-dangerous weapon.
Joshua Lee Dwain Zachery, 27, of 211 Laura Ave., Apt. 105, Detroit Lakes, was apparently living with his spouse and two children at a Detroit Lakes residence before the incident occurred.
According to the criminal complaint, his wife awoke early on the morning of Aug. 10 to find that both he and their two children were missing, along with a handgun that was allegedly owned by Zachery.
The woman said that Zachery had informed her and their two children, ages 3 and 5, that they would need to get up early on Aug. 10 because he had a "surprise" for them.
When she woke that morning, the woman discovered that her husband and children were nowhere to be found, and that Zachery had not left a note or called to say where they were.
She later discovered that the children's medical records and birth certificates were missing along with the couple's tax records, marriage certificate and some pictures of the children.
Zachery's cell phone records indicated that it had been used in South Dakota, Iowa and Nebraska, and attempts to call him at that number went unanswered.
Court records indicate that Zachery was arrested in Waco, Texas (where he reportedly had relatives), on Aug. 11, and that the children were with him. The handgun was also in his possession at the time of his arrest.
Zachery is currently in custody at the Becker County Jail pending his next court appearance, at an Aug. 27 Rule 8 hearing. His bail was set at $75,000 with conditions, or $150,000 without conditions.
