NOTICE IS HEREBY GIVEN, that under and by virtue of a Judgment made and entered in the above entitled action on 21st day of July, 2016, by the District Court of Wadena County, Minnesota, Seventh Judicial District, and an Assignment of Judgment assigning the Judgment to Nina G. Lewis was made and entered in the above titled action on 30th day of January, 2017 and filed on the 13th day of February, 2017, by the District Court of Wadena County, Minnesota, Seventh Judicial District, and certified copies of which have been delivered to me directing the sale of the premises hereinafter described, to satisfy the amount found and adjudged due plaintiff in the above entitled action from Defendant John G. Smart, as prescribed in the Judgment, the undersigned Sheriff of Wadena County will sell at public auction, to the highest bidder, for cash, on the 28th day of November, 2017, at 10:00 a.m., at the Lobby of the Wadena County Sheriff’s Office, 415 Jefferson St. So., #101, Wadena, MN 56482, the premises and real estate, lying and being in the County of Wadena, State of Minnesota, described in said Judgment, to wit: Part of the Northwest Quarter of the Northeast Quarter (NW ¼ NE ¼) of Section 1, Township 138 North, Range 35 West of the Fifth Principal Meridian, described as follows: Beginning at the Southwest corner of Lot 1, Malchow’s Lake Addition to Twin Lakes, which is also the Southeast corner of Government Lot 2 in above Section; thence North along the East side of Government Lot 2, approximately 490.5 feet to the Southeast side of County Road #4; thence along the Southeast side of County Road #4 in a Southwesterly direction, a distance of 329 feet to a point; thence Southeasterly a distance of approximately 400 feet to the lakeshore of Twin Lakes; thence Northeasterly along the Northwest shore of Twin Lakes, a distance of approximately 65 feet to the point of beginning. (hereinafter the “Premises”). The Mortgage is dated October 22, 2003 and recorded November 3, 2003 as Document No. 204975 and Modified by a Modification of Mortgage dated December 19, 2012 as Document No. 234720 and Assigned by an Assignment of Mortgage recorded on February 7, 2017 as Document No. 246172 in Wadena County Recorder’s Office of Wadena County, Minnesota. The original principal amount secured by the Mortgage was $475,000.00. At the date of this notice the amount due on the Mortgage, including taxes, paid by holder of Mortgage is $100,714.00. The time allowed by law for redemption by Mortgagor or assigns is twelve (12) months. Minn. Stat. §580.04(b) provides, “If the real east is an owner-occupied, single family dwelling, the notice must also specify the date on or before which the mortgagor must vacate the property if the mortgage is not reinstated under section 580.30 or the property redeemed under section 580.23.” The time to vacate the property is 11:59 p.m. on November 28, 2017.
